Terms of Service
Please read these Terms of Service carefully before using the Be Social website. They explain what you may and may not do, how we handle your information, and the legal relationship between you and 321 Digital, Inc.
Introduction
These Terms of Service (“Terms”) govern your access to and use of the public website at https://besocial.pro/ (the “Website”). Be Social is a product brand operated by 321 Digital, Inc. (“Be Social,” “we,” “us,” or “our”).
By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.
1. Pre-launch website
The Website provides information about a planned social media management product that is still in development. Member accounts, live social integrations, AI-provider connections, scheduling, publishing, pricing, subscriptions, support services, and launch timing have not been finalized or made generally available.
Website descriptions, mockups, workflows, platform references, planned capabilities, and pricing concepts are informational and may change. Nothing on the Website guarantees that a feature, integration, plan, price, release date, or service will become available.
2. Eligibility
The Website is intended for adults acting for themselves or on behalf of a business or organization. You must be at least 18 years old, or the age of legal majority where you live, to submit the contact form.
3. Permitted use
You may access and use the Website for lawful informational and business-evaluation purposes. You may print or save a reasonable portion of the Website for your own internal evaluation, provided you do not remove proprietary notices or misrepresent the content.
4. Prohibited conduct
You may not use the Website to violate law; infringe intellectual-property or privacy rights; submit malicious code, spam, or fraudulent information; interfere with security or availability; attempt unauthorized access; scrape or harvest personal information; impersonate another person or organization; use automated systems in a manner that unreasonably burdens the Website; or reproduce, sell, sublicense, or exploit Website content except as expressly permitted.
You may not submit passwords, API keys, payment information, government identification numbers, health information, or other sensitive or confidential data through the public contact form.
5. Intellectual property
The Website, Be Social name, logo, visual identity, copy, graphics, layouts, mockups, and other original content are owned by or licensed to 321 Digital, Inc. and are protected by intellectual-property laws. Except for the limited use permitted in these Terms, no right or license is granted.
Third-party platform names, logos, and trademarks belong to their respective owners. References to Facebook, Instagram, X, LinkedIn, TikTok, YouTube, Threads, Pinterest, Discord, AI providers, or other services do not imply sponsorship, endorsement, partnership, or guaranteed integration availability.
6. Contact submissions and feedback
If you submit an inquiry, you represent that the information is accurate to the best of your knowledge and that you have the right to provide it. We may use the information to review and respond to the selected inquiry, evaluate interest in the planned product, consider a potential partnership, or process a privacy request as described in the Privacy Policy.
If you voluntarily provide ideas, suggestions, or feedback, you grant 321 Digital, Inc. a nonexclusive, worldwide, royalty-free right to use that feedback to evaluate, develop, and improve Be Social without an obligation to compensate you. Do not submit confidential or proprietary ideas through the public form.
7. No relationship or commitment
Submitting a form, requesting early access, discussing a partnership, or reviewing Website content does not create a customer, client, agency, partnership, joint venture, employment, fiduciary, advisory, or support relationship. It does not guarantee a response, early access, product availability, pricing, an integration, or a commercial agreement.
8. Third-party links and services
The Website may contain links to third-party websites or discuss third-party platforms and APIs. We do not control third-party services and are not responsible for their content, availability, security, terms, or privacy practices. Your use of a third-party service is governed by that provider’s terms and policies.
9. No professional advice
Website content is general product and marketing information. It is not legal, financial, tax, medical, compliance, or other professional advice. You are responsible for obtaining appropriate advice and reviewing any future social media content for factual accuracy, rights, disclosures, platform rules, and laws applicable to your business.
10. Disclaimer of warranties
The Website is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Be Social and 321 Digital, Inc. disclaim warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, title, noninfringement, uninterrupted availability, or freedom from harmful components.
We do not warrant that pre-launch descriptions will remain unchanged or that any planned feature, integration, platform capability, pricing structure, or launch date will become available.
11. Limitation of liability
To the fullest extent permitted by law, Be Social, 321 Digital, Inc., and their officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, data, goodwill, or business opportunity; or damages arising from reliance on pre-launch information, use or inability to use the Website, third-party links, or unauthorized access to information.
Some jurisdictions do not allow certain disclaimers or limitations, so portions of this section may not apply to you. Nothing in these Terms limits liability that cannot lawfully be limited.
12. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Be Social, 321 Digital, Inc., and their officers, employees, contractors, affiliates, and service providers from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of the Website, violation of these Terms, infringement of another person’s rights, or information you submit without authority.
13. Changes to the Website or Terms
We may modify, suspend, or discontinue any part of the Website and may update these Terms as the project develops or legal requirements change. Revised Terms will be posted on this page with an updated Last updated date. Your continued use after an update means you accept the revised Terms.
14. Future Be Social application
The future Be Social application, member accounts, paid plans, integrations, AI features, customer content, and support services will be governed by additional or replacement agreements published before those services are offered. These Website Terms do not create a subscription or grant access to the application.
15. Governing law
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Any dispute concerning the Website or these Terms will be brought in a court of competent jurisdiction in Colorado, unless applicable law requires a different venue.
16. Severability and waiver
If a provision of these Terms is found unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be modified only to the extent necessary to make it enforceable. A failure to enforce a provision is not a waiver of the right to enforce it later.
17. Entire agreement
These Terms and the Privacy Policy are the entire agreement concerning use of the current public Website and replace prior discussions concerning that use. They do not replace a separate written agreement signed by 321 Digital, Inc.
18. Contact
